Creative Bypass of Legal Restrictions?

The eagle-eyed folks at Legal Blog Watch have re-posted this picture of the store-front of an entity that is presumably seeking to evoke certain words, marks, or symbols it is not actually permitted to use:

Supposedly, the legal lock-down for this year's event is stricter than in prior years.  If so, I wonder if the attempt at heavy-handed suppression has provoked uses like this.  

That is, are some of the close-to-the-line, in-your-face uses (like this one) perhaps undertaken by folks who would not have infringed under normal guidelines and standards, but who were so annoyed by what they perhaps saw as over-lawyering or hyper-regulation that they decided to dance as close as they possibly could to (or around) the line, just to annoy the Establishment?
